Man With a Van Redbridge Terms and Conditions

These Terms and Conditions set out the basis on which Man With a Van Redbridge provides removal and related services within the United Kingdom. By making a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 "Company" means Man With a Van Redbridge, the provider of removal and related services.

1.2 "Customer" means any individual, business, or organisation that books or uses the services of the Company.

1.3 "Services" means any removal, transport, loading, unloading, packing, storage, or related services provided by the Company.

1.4 "Goods" means any items, belongings, furniture, equipment, or materials that are handled, transported, or stored by the Company on behalf of the Customer.

1.5 "Service Area" means the geographical areas within which the Company offers its services, including but not limited to Redbridge and surrounding districts, as reasonably determined by the Company from time to time.

1.6 "Contract" means the agreement between the Customer and the Company for the supply of Services, incorporating these Terms and Conditions and any written confirmation of booking.

2. Scope of Services

2.1 The Company provides man and van services, household and office removals, small and medium-sized moves, local and regional transport of goods, and related removal services within its Service Area and throughout the UK, as agreed at the time of booking.

2.2 The specific Services to be provided, including the number of personnel, size of vehicle, estimated duration, and any additional requirements, will be confirmed at the time of booking based on the information provided by the Customer.

2.3 The Company reserves the right to decline any booking request at its discretion, including where the requested service is outside the Service Area, unsafe, unlawful, or unsuitable for the Company’s vehicles or personnel.

3. Booking Process

3.1 Bookings must be made directly with the Company through its accepted communication channels. A booking is not confirmed until the Company has provided explicit confirmation, which may be given verbally or in writing.

3.2 At the time of booking, the Customer must provide accurate and complete information, including:

(a) Collection and delivery addresses;

(b) Details of access at each address, including any parking restrictions, stairs, lifts, or long carry distances;

(c) An accurate description and approximate volume of the Goods to be moved;

(d) Any particularly heavy, bulky, fragile, or valuable items;

(e) Desired date and time for the Service.

3.3 The Customer is responsible for ensuring that all information provided is correct. If the information given is incomplete or inaccurate, the Company may adjust the quoted price, change the type of vehicle or number of staff supplied, extend the estimated time, or in some cases refuse to carry out the Service.

3.4 Any time or date for performance of the Services is an estimate only. While the Company will take reasonable steps to meet agreed timescales, it cannot guarantee arrival or completion times and accepts no liability for any loss or inconvenience caused by delays beyond its reasonable control.

4. Quotes and Pricing

4.1 Quotations are based on the information supplied by the Customer and on the assumption of reasonable access and normal working conditions.

4.2 Unless otherwise stated, quotations are exclusive of tolls, congestion charges, parking costs, ferry charges, and any additional statutory or local fees which will be payable by the Customer as incurred.

4.3 The Company may adjust the price if:

(a) The Customer changes the service requirements, date, time, or addresses;

(b) The volume or nature of the Goods differs from that stated at the time of booking;

(c) Access issues, delays caused by the Customer, or other unforeseen circumstances significantly extend the duration of the job;

(d) Additional labour or equipment is required.

4.4 Where Services are charged on an hourly basis, the minimum charge and subsequent charging increments will be stated at the time of booking. Time may include travel to and from the job and any necessary waiting time.

5. Payments

5.1 The Customer agrees to pay the price quoted or the hourly rate agreed, together with any additional charges properly incurred under these Terms and Conditions.

5.2 The Company may require a deposit or full pre-payment in order to confirm a booking. Any required deposit will be specified at the time of booking.

5.3 Unless otherwise agreed in writing, payment of any remaining balance is due immediately upon completion of the Services on the day of the move.

5.4 The Company accepts payment by methods that it confirms as acceptable at the time of booking. Cash payments must be made directly to the driver or operative responsible on the day of the Service, unless an alternative arrangement has been agreed.

5.5 If payment is not made when due, the Company reserves the right to:

(a) Suspend or refuse to provide any further Services;

(b) Charge interest on overdue amounts at the statutory rate;

(c) Retain possession of Goods until payment is received in full, subject to applicable law.

6. Cancellations, Postponements and Waiting Time

6.1 If the Customer wishes to cancel or postpone a booking, the Customer must notify the Company as soon as possible.

6.2 The Company may apply cancellation charges on a reasonable basis, which may include:

(a) No cancellation fee if the Customer cancels with sufficient notice before the scheduled start time, as reasonably determined by the Company;

(b) A partial charge where cancellation is made at short notice and the Company has incurred costs or lost the opportunity to take other bookings;

(c) Up to 100 percent of the quoted price where the Customer cancels or does not attend on the day of the Service.

6.3 Postponements at the Customer’s request may be treated as cancellations and re-bookings, and may incur charges at the Company’s discretion.

6.4 If the Company arrives at the collection address at the agreed time and is unable to commence work due to reasons beyond its control, including but not limited to lack of access, Goods not being ready, or issues with keys or paperwork, waiting time will be charged at the Company’s standard hourly rate.

7. Customer Responsibilities

7.1 The Customer is responsible for:

(a) Ensuring that adequate parking is available at both collection and delivery addresses, and for any parking permits or arrangements required;

(b) Paying or reimbursing any parking fines or charges incurred as a result of inadequate or illegal parking where the Customer has directed the Company to park;

(c) Properly packing, securing, and protecting Goods unless packing services have been expressly agreed;

(d) Identifying fragile or high-value items and informing the Company of any special handling requirements;

(e) Ensuring that all Goods are ready to be moved at the agreed time.

7.2 The Customer must not request the Company or its staff to undertake any illegal activity, including illegal parking, carrying prohibited items, or breaching waste regulations.

7.3 The Customer or an authorised representative should be present at collection and delivery to direct the loading and unloading and to check Goods at the end of the move. If no representative is available, the Company will carry out the Service using reasonable care, but accepts no liability for discrepancies that could have been identified at the time.

8. Excluded and Restricted Items

8.1 Unless expressly agreed in writing, the Company will not transport:

(a) Hazardous, illegal, or dangerous goods, including explosives, flammable liquids, gases, or chemicals;

(b) Live animals or plants;

(c) Perishable foods or items requiring temperature-controlled transport;

(d) Cash, jewellery, precious metals, securities, or other items of exceptional value;

(e) Waste or items intended for disposal, except as permitted under waste regulations and properly declared at booking.

8.2 If such items are transported without the Company’s knowledge, the Company will have no liability for any loss, damage, or consequences arising and may, where lawful, remove or dispose of such items at the Customer’s cost.

9. Waste and Recycling Regulations

9.1 The Company operates in accordance with applicable UK waste and environmental regulations. The Company is not a general waste carrier unless this has been clearly stated and the necessary licences and arrangements are in place.

9.2 Where the Customer requests removal of items for disposal, the Customer must accurately describe the nature of the items and confirm whether they are household, commercial, recyclable, or restricted waste.

9.3 Certain items, such as electrical equipment, appliances, mattresses, or construction debris, may be subject to additional regulations and disposal fees, which will be charged to the Customer.

9.4 The Company reserves the right to refuse to carry or dispose of any items that it reasonably believes to be prohibited, hazardous, contaminated, or not properly declared.

9.5 The Customer remains responsible for any penalties, fines, or claims arising from false declarations or breaches of waste regulations in relation to Goods presented for removal or disposal.

10. Liability and Insurance

10.1 The Company will exercise reasonable care and skill in providing the Services. However, the Company’s liability for loss or damage to Goods is limited as set out in this section.

10.2 The Company will not be liable for:

(a) Loss or damage arising from the Customer’s failure to adequately pack, protect, or label Goods;

(b) Damage to furniture or other items that requires dismantling or reassembly, where such work is carried out at the Customer’s request;

(c) Loss or damage to items with pre-existing defects or weaknesses;

(d) Loss of profits, business interruption, loss of data, or any indirect or consequential loss;

(e) Loss or damage arising from circumstances beyond the Company’s reasonable control, including but not limited to acts of God, adverse weather, road closures, traffic delays, accidents, or third-party actions.

10.3 If the Company is liable for loss of or damage to Goods, its liability will, to the fullest extent permitted by law, be limited to the reasonable cost of repair or the current market value of the Goods, whichever is lower, subject to any applicable overall limit that the Company may specify.

10.4 The Customer is encouraged to arrange suitable insurance cover for Goods in transit, particularly for high-value or fragile items. Any optional additional cover offered by the Company will be subject to separate terms and written confirmation.

10.5 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by the Company’s negligence, fraud, fraudulent misrepresentation, or any other liability which cannot lawfully be limited or excluded.

11. Claims and Complaints

11.1 The Customer should inspect Goods as soon as reasonably possible after completion of the Services.

11.2 Any visible loss or damage must be reported to the Company at the time of delivery or within a reasonable period afterward. The Company may request supporting evidence such as photographs, receipts, or repair estimates.

11.3 The Company will investigate any complaint or claim in good faith and may, at its discretion, offer repair, compensation up to the applicable liability limit, or another appropriate remedy.

12. Access, Property Damage and Parking

12.1 The Customer must ensure that the premises at both collection and delivery addresses are safe and suitable for the Services to be carried out.

12.2 While the Company will take reasonable care to avoid damage to property, it will not be liable for damage to internal or external surfaces, fixtures, or fittings where:

(a) Access is restricted or requires moving large or heavy items in confined spaces;

(b) The Customer requests the Company to proceed despite advice that such movement risks damage.

12.3 Any parking charges, congestion charges, tolls, or similar fees incurred in the course of delivering the Services will be payable by the Customer in addition to the quoted price.

13. Subcontracting

13.1 The Company reserves the right to subcontract some or all of the Services to carefully selected third parties, particularly for longer-distance moves or where capacity requires.

13.2 Where Services are subcontracted, these Terms and Conditions will continue to apply, and the Company will remain responsible for the overall performance of the Contract.

14. Data Protection

14.1 The Company will collect and use personal data provided by the Customer for the purposes of managing bookings, delivering the Services, handling payments, and dealing with enquiries and complaints.

14.2 The Company will handle personal data in accordance with applicable UK data protection laws and will not sell or share personal data with third parties except as necessary to perform the Contract or as required by law.

15. Termination

15.1 The Company may terminate the Contract or suspend Services immediately if:

(a) The Customer commits a serious breach of these Terms and Conditions;

(b) The Customer behaves abusively, aggressively, or in a threatening manner towards the Company’s staff;

(c) The Company reasonably believes that continuing the Services would be unsafe, unlawful, or impracticable.

15.2 On termination, the Customer will remain liable to pay for all Services provided up to the date of termination and any reasonable costs incurred by the Company as a result of the termination.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute, claim, or issue arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.

17. General

17.1 If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy.

17.3 The Customer may not assign or transfer any of their rights or obligations under the Contract without the Company’s prior written consent.

17.4 The Company may update these Terms and Conditions from time to time. The version in force at the time of booking will apply to that Contract unless otherwise agreed.
